Bestway International, a company based in Nigeria, has engaged Barrister Junaid Ahmed of JA Legal for its recovery claim against a local Pakistani company. It is important to highlight that the High Court of Lagos State in the Ikeja Judicial Division has passed a judgment in favor of Bestway International, but as the Defendant company is based in Pakistan, the judgment needs to be executed before the Pakistani courts.
At present, Pakistan has no reciprocating agreement with Nigeria for direct execution of judgments passed by the Nigerian Court. Thus, a fresh suit will have to be filed based on the judgment passed by the non-reciprocating territory, being the cause of action for the suit.
