Sindh High Court at Karachi on 23.08.2021 restrained Pakistan Agricultural Research Council (PARC) from taking “any coercive action” against the retired Civil Servant/Petitioner.
By way of background, the Constitutional Petition was filed by a retired civil servant who last served as the Senior Scientific Officer. The issue arose when the Petitioner, being aggrieved by the notice passed by PARC, was unlawfully, arbitrarily, and malafidely threatened that PARC might withdraw his two promotions awarded approximately 17 years ago, i.e., in 2004 to BS-17 and in 2012 to BS-18, in blatant violation of the law, service rules, and the Constitution.
The Petitioner engaged Barrister Junaid Ahmed along with Barrister Umair Usman before the Sindh High Court to pursue the case. It must be noted that the withdrawal of promotions does not directly violate the fundamental rights of the Petitioner, but the act would directly affect his pension.
